Assault & Battery - Criminal Law

Saturday, October 20th, 2007

By Todd Going Each year there are over 800,000 assaults reported to local law enforcement agencies. Assault is typically defined as trying to strike an individual when the individual is aware of the danger being presented. A felonious assault is an attack, or attempt to attack, through force, in order to cause physical injury to an individual. Even if the individual doesnt get hurt, but a weapon is involved, then it still falls under the category of a felony. Assault & Battery is an incident where actual contact was made and resulted in the need for medical treatment. This is also a felony. The consequences of an assault crime can be imprisonment, probation, fines, anger management classes and more. The punishment usually has to do with the circumstances of the situation and the background of the offender. If the offender has a prior history of assault these punishments will most likely be inflated. Not every instance of an assault crime is straight forward and clear-cut. For instance, an assault may have been committed due to self-defense or defending another person or property. This is why it is so important to hire a professional assault attorney. A qualified attorney will be able to complete an extensive investigation and use their professional expertise to help dismiss or minimize the sentence. Getting Your Message Out: Why Once is Not Enough

Friday, October 19th, 2007

By Deborah Henken It continues to amaze me that companies are willing to spend huge amounts on developing a product and then want to squeeze the marketing budget. Getting your message out is not the place to cut costs. Why? We, as customers, are bombarded with marketing messages all the time, in all kinds of places, and the types of marketing just keep expanding. In the old days of the 80s, where media choices focused on radio, TV, newspaper, magazine and billboards, it used to be that the advertising world used the metric of 3 an ad must run at least three times in each media choice to break through the clutter. Now, with increasing kinds of media email, banner ads, websites, cell phone and PDA messages, ads on buildings, ads on taxi cabs, ads on grocery carts and on and onthe new metric is 7 impressions. A customer must see your message an average of 7 times for it to stand out from all the other messages they see each day. Thats right, 7 times. The first time or two, it may not be noticed. By the 4th, 5th , 6th or 7th time, the human brain starts realizing theyve been seeing a lot about this product or company! When companies decide they can get by with only one direct mailing with no follow-up or a one-time ad, they are not getting the most bang for the buck. They are not ensuring they will rise above the noise and get their unique benefits noticed. People must see your message again and again, until it penetrates and makes your targets take the action you want generating leads and sales. Are there some marketing communications that get attention in one fell swoopabsolutely. The Apple ad in SuperBowl 1984, for instance, was only run once. These type communications are usually backed by big budgets, however–producing an ad and buying Super Bowl space is not exactly inexpensive. In this case, you may be able to get your message across in one time. However, the amount spent will more than equal what can be done with integrated marketing activities. On the other side of the spectrum are viral marketing activitiesbut by the time you discover them, everyone else is using them too. Not that this is bad, just that they should be incorporated into the Once is Not Enough Plan) Whats a business person to do? The good news is that you dont have to just do one marketing activity 7 times–there is a way to break through the clutter and stand out in a customers mindand that way is through integrated marketingusing a variety of methods to gain awareness, move the prospect to interest and demand and then to a sale. Next month we will be discussing Integrated Marketing and Doing It Right. Right now, you should be auditing what you are doing, making sure you are not doing one shot marketing, which just does not make effective use of your marketing resources. Action Steps To Take Now: 1) Audit your current marketing efforts-identify what activities you are doing 2) Review what you are doingare you doing one-shot activities or following through and consistently touching your target audience with your messages and benefits 3) If you are doing one-shot activities, determine what you can do to expand. If you did a one-time ad, identify places to run it again. If you did a direct mail, mail to the audience again with a new offer. Just because they dont answer the first time, does not mean they are not interested. Remember, the average is 7 times to make an impact. The Best Way I Know To Lose Stubborn Belly Fat

Thursday, October 18th, 2007

By Marc David Everyone wants to know how to lose fat around their abs, well, here’s how I do it… The #1 question that is asked on all fitness sites, bodybuilding forums, magazines and late night TV infomercials sounds a lot like these: How to I lose the stubborn belly fat? How do I lose abdominal fat? How to do I get great abs? How do I lose the stomach pouch off the lower abs? These are all too common question and they are so popular that it’s the reason the weight reduction arena is a multi- billion dollar (yes billion) industry. You are about to read the real secret to great abs and how to lose the abdominal fat without spending money on supplements or following some diet-of-the-month and it’s going to be a very simple formula that you can follow. Remember… Your abdominal muscle is like the rest of the muscles in your body. They require training if you want them to be larger and stronger. A common mis-conception is that you must train your abs several times a week. This will only lead to overtraining. Your abs are a muscle. Train it like everything else. No need to focus and go overboard. Two to three times a week of focused ab work or core strength is generally the rule for 6 pack abs. An Easy 3-Step System For Ripped Abdominals: Step 1 Training: 1% of your overall ab development will actually come from training. Consider the fact that most people think 90% of your results come from training, you can see this isn’t the popular consensus. Needless to say, that’s where most focus their efforts. They don’t get their nutrition in order, they don’t use cardio effectively so the masses just do more ab training and more crunches. Ultimately for your abs to show you must have abs to show and a low percentage of body fat for them to appear. More training does nothing to eliminate the layer of fat that is covering them. This is commonly know as spot reduction. Training an area for the sole purpose of eliminating fat in that area. Tip - Do not make training the #1 priority to show off those abs. Train them like any other muscle. More ab work will not make your abs appear. Focus on lowering your body fat levels and not spot reduction. Step 2: Cardio: 9% of your effort can be directed as using cardio as a fat burning tool. High intensity interval training is by far the fastest and most efficient method you can use to shed the pounds. You’ll want to keep in mind, using cardio is a tool. Not a foundation. This simply means that doing marathon sessions will not be to your advantage. Learn to use cardio effectively and you can enhance and boost your metabolism beyond what even eating the right foods can do. Some competitive bodybuilders use cardio up to twice a day for 30 days to just chisel off that last remaining layer of fat that’s cover up the abdominal region. Tip - Cardio can be done twice a day for a full body shock! Just keep in mind this method is a short term tool and not a routine you would use for any length of time. Step 3: Nutrition: 90% of your efforts will be based upon your diet. In order to show off the abs, you must get rid of the layer of fat that is covering them up. It is that simple. Many people will train their abs and do all kinds of cardio and they still forget that nutrition plays such a massive roll in getting rid of belly fat. You must know how many calories a day you need to eat and what to eat in order to get your nutrition on track and working for you. Going to the gym more often, doing more cardio and more hanging crunches will do you no good if you fail 90% of the test. Tip - Use nutritional fundamentals to turn your body into a fat burning furnace. Wait just a second… Before you rush off to check your nutrition, cardio and training, take this next concept into consideration. Loose Skin: Skin is very elastic and over time (age) or with a large amount of weight reduction it may not just spring back like it did. In this case, surgery may be the only option once you have reached a very low level of overall body fat. -Many women may experience this because of pregnancy. -Many men and women may experience this because of a large amount of weight reduction. For example, if a man was under 10% body fat and had loose skin, this is a prime example where skin may need to be taken away because of other circumstances. While this is pretty rare it does happen and if the skin cannot bounce back, there’s little options a person has except to have it removed. What this means is… If you have a low enough (12-15% or less body fat for a woman in this example) and you still have a lot of loose skin from slimming down or pregnancy, you may want to explore the option of having that excess skin removed. With that said… The secret to ripped abs is nothing more then 3-steps in this order of importance: -Nutrition -Cardio -Training You see, all of the programs you’ll find will adhere to these 3 concepts. Once you have the abs, you need to show them. In order to show them, you will need to get rid of the layer of fat that is covering them up. It’s easy to lose the belly fat when you know how. Winning Your Weight Loss War For A Lifetime

Wednesday, October 17th, 2007

By Beth Scott Are you fighting the uphill battle of weight loss? Stuck with notknowing who or what to listen to anymore? One person tells you one thing, the next tells you do the exact opposite. Who should you believe? There are so many weight loss diets and plans out there that it’sgrowing increasingly harder to decide what actually works and what isn’t even worth wasting your time on. You’ve gotta know that all of these “miracle” weight loss diets and plans are not what they claim to be, simply because if they all did exactly what they promised to, there wouldn’t be a single obese or overweight person left on earth! The reason so many useless weight loss diets and plans are stillaround is because most of the useless ones promise “INSTANT Weight Loss!” Now, tell me who is going to pass up at least trying something like that? Us humans can be mighty lazy at times and wanting everything to be instantaneous is one of our chief bad habits. We want our meals prepared instantly at restaurants, we demand web pages to load instantly or we’ll just close them, and we alsodesperately want instant weight loss. You suspect in the back of your mind of course, that this isimpossible, but still you can’t help being sucked in by those oh so tempting promises of instant gratification. “Maybe this one will be different.” You tell yourself “It has tobe.” But the honest, and yes painful, truth is that weight loss isnever instantaneous. You can’t just pop some magicpill, go to sleep, and wake up 50 pounds slimmer. YOUR BODY DOESN’T WORK THAT WAY! Once your body has stored a certain amount of fat, it’s going to want to hold on to it (for dear life it sometimes seems). What you need to do is force your body to be more willing to burn up that fat, by revving up your metabolism. You also need to make sure you’re doing all the right things toaccomplish this revving up. There are too many ways to rev yourmetabolism for me to go into them all here, but I’ll give you a short list of some TRULY KEY things you can do to rev your metabolism until it’s roaring along like the ocean surf. 1. Do NOT Skip Meals. Never, never, never skip a meal if you truly want to rev up your metabolism. If your body thinks you are starving it will actually slow your metabolism down (causing you to burn fat much slower) in an attempt to “keep you alive.” Maybe you don’t always have time for meals. Okay, I understand that. Just grab something easy, but nutritious and filling in place of a meal (nuts, fresh fruits & veggies can be quick fixes when you’re on the go). 2. Live A Spicier Life Eating spicy foods can dramatically speed up your metabolism. Try making a jalapeno salsa that you can use on sandwiches or salads. Chopped jalapenos also make a great addition to almost any meat, egg or vegetable dish. 3. Enjoy The Air And Your Favorite Game Breathing deeply while exercising is also very important forgiving your metabolism that extra little “push” it needs. You should do some form of exercise every day, for at least 20 minutes that will cause you to breathe deeply, get your heart racing, and make you break a sweat. This doesn’t have to be painful, do something you already love. Play your favorite “game” or sport. Go biking, skating, swimming, etc. The possibilities are really endless. Exercise doesn’t need to be boring, what it needs to be is something you truly love doing and will be sure to find the time for at least 5 days out of every week. Something you’ll actually look forward to. Do yourself a favor, get your metabolism raring so that you can stop worrying about your weight and start enjoying life. Halloween - The Ultimate Dress-Up Event

Tuesday, October 16th, 2007

By Peter Koonz Chances are that you’ve had a very busy year like just about everyone else has, and so you’ve had fewer chances to spend good quality time with your kids than you’d like. Well, it’s a fact of modern life, but there are still some really good times to take advantage of. Halloween is one of them. It’s a night full of fun and excitement, and you can tailor it to just what you want. Your kids are probably already talking about what they want to do for the holiday, and so that means it’s time for you to start thinking about how to make it one of the memorable times for your family. The fact is that, despite whatever else it may be, Halloween is the ultimate in dress-up events, and what kid doesn’t love to have a dress-up party? This is one where you can really let loose and have fun being as goofy or as scary as you want. And the great thing is that you can even all go out in public that way, and no one will even think differently of you for it! How great is that? Here’s what you can do to make the whole thing worthwhile. First of all, take time now to think about what you would like to do for this Halloween. Make a list of some of the activities that you would like to have. Will you go trick-or-treating through the neighborhood? Or would you rather take the kids to the mall and have the same kind of fun there? How about a haunted house? There are many types of haunted houses out there, and they’re not necessarily too scary for little ones. It’s up to you. There are still more options. But the key to the holiday is dressing up. Once you’ve come up with the ideas for how to spend Halloween, it’s time to get the kids involved. Have a talk with them about what you think would be fun this year, and then get their input. You may find that they have some new ideas that are even better than the ways you spent Halloween as a kid. Plan the whole thing out with them. You’ll be making it a lot more fun for your children when you let them in on the decision-making. They love to feel like they have a responsibility in what’s going on. The more they can do, the better time they’ll have. When it comes to the actual dressing up, make it as fun as you can. Of course, you’re going to need to find costumes suitable to your rules, and their tastes also. For girls, fairy costumes are sure to be a hit. She can either be a cute, gentle fairy, or she can be something just a little scarier and more mischievous if that is to her liking. Copyright 2006 MagicFairyRealm.comMusic, drinks, snacks, and whatever else you can think of should be part of the dress-up party. This is really a chance for you to have a “party before the party”. It also gives you time to make sure your kids know the do’s and don’t’s of the plans for the evening. And you can get all that in while having fun the whole time. Think about it, plan ahead for the holiday, and you’ll soon find you and your kids having more fun than you’ve had all year! Your FICO Score and Applying for a Loan

Saturday, October 13th, 2007

By [http://ezinearticles.com/?expert=Joseph_Kenny]Joseph Kenny Have you wondered how loan and mortgage companies decide whether or not to lend you money when you apply for a loan? For nearly all, the decision is based on one version or another of a ‘credit score’ based on your credit report. The most commonly used credit scoring ‘device’ is the FICO - software developed by Fair Isaac and Company to evaluate credit histories. When you make an application for a mortgage loan, the finance company or bank makes an inquiry to a credit reporting agency. The credit reporting agency takes the information given them by the finance company and compiles a report based on information in its own records and other information that’s a matter of public record. That information is not only compiled, it’s fed into a software program that uses a series of algorithms to estimate the likelihood that you’ll pay the loan back. It makes that estimation by comparing information about you with a profile created by compiling the ‘ideal borrower’. The closer your information tallies with the ‘ideal’ profile, the higher your credit score. Among the things that the FICO software evaluates when coming up with a credit score are: - the length of time you’ve been in your current job - the length of time you’ve lived at your current address - how long you’ve had credit of any kind - how many credit cards and loans you have - whether you’ve ever made any late payments (or made any in the past four years) on credit accounts - if you’ve paid off any loans in full - if you’ve ever had an account referred to a collection agency - how much debt you carry - how much credit you have available to you Those are only a few of the factors that affect your credit score. But just how much does your credit score affect your chances of getting the mortgage you want? According to many financial experts, while your credit score is a large factor in determining whether or not to grant a loan or mortgage to you, banks and finance companies take many factors into account. Most have their own underwriting rules and scoring systems of which the FICO is only a part. Those may include your employment history, the local job market and many other things. Based on all of those factors, a company may decide to extend a mortgage to you despite a low credit rating - or refuse you credit even if your credit rating is high. One common belief is that a low credit score is forever. Nothing could be further from the truth. Your credit score is very fluid - it’s meant to represent a picture of your current circumstances and ability to repay a loan that’s extended to you. For that reason, new information added to your credit report will affect your credit score - and the further in the past that credit mistakes are, the less they matter. In some cases, it takes as little as 4-6 months of on time payments to bring your credit score up high enough to qualify you for a new loan or mortgage. A new job, a raise in salary, or paying down one or two credit cards could make the difference between a rejection and getting the mortgage that you want. Thin Is In! Get Thin Quickly!

Thursday, October 11th, 2007

By Nathalie Fiset Ever wonder how those celebs do it? On how they can lose weight quickly. Take for example Uma Thurman. She was pregnant months before filming “Kill Bill” but look at her in that movie. She was kicking ass. Hard to imagine that she just gave birth eight weeks prior to filming. It does not stop there. You wonder how Angelina Jolie lost the baby weight after giving birth to her first biological child Shiloh. No wonder Brad Pitt is smitten over her. It is like she has superpowers. With just one snap of her fingers. Voila! No more baby weight! But magic powers don’t exist. What exists is the discipline of the person to shed those unwanted pounds. There are so many procedures and methods for anyone to lose the excessive weight which makes him or her conscious on a physical level. Because of the rampant information that are broadcasted and shared through many types of media, the real diets are mixed up with the fad diets and it is difficult to determine which is which. Nutrition experts advise those who want to venture into dieting to eat healthy and to not restrict themselves by skipping meals just because it means they will be able to reach their target weight faster. An example of a misleading weight loss diet is the infamous cabbage soup diet. This would only result to abdominal discomfort and flatulence, making you weak on a physical level. Not only will you be disappointed because you didn’t lose weight, you’ll also be shocked on your hospital bills. What one must know about quick weight loss diet is that it does not imply a particular food. A diet is targeted to losing weight on a healthy manner. By eating a balanced diet which consists various foods providing the human body with the vitamins and minerals it need, then losing weight can be achieved. It is how you stick to it and how determined you are in restricting yourself from indulgences such as sweets and carbohydrates that would determine how fast you can get your ideal weight. Here’s one basic tip on choosing the right diet for you. Decide on which diet in particular you will be concentrating on. What about it makes it easier for you to commit your lifestyle? By staying on that diet, then you have accomplished the first step in losing weight. Try to eat in moderate amounts. What you eat normally, lessen it. In that way, you are not entirely restricting yourself. You are simply cutting back on what could be additional carbohydrates, fats and sugars in your body. There is no such thing as “superfoods.”That’s like saying Angelina Jolie can just snap her finger then voila, she lost her baby weight. Diets that convince people there is “superfood”is a fad diet and smart people know that in an instant. Sometimes these diets endorse a health association to make it seem that they are credible when it comes to advising people on the right diet. The public must be aware that the American Heart Association diet chart recommends servings each day from various food categories and not just the specific foods that are often indicated in these fad diets. Simply put, if you want to lose weight quickly then just reduce the saturated fat and trans fat in your meal. Do not eat too much sweets. Eat more vegetables, fruits and whole-grain foods. You can also move to fat-free or low-fat dairy. Dr Nathalie Fiset is a family doctor and a certified hypnotherapist. Plessy vs Ferguson - African American History Essay

Wednesday, October 10th, 2007

By Michael Cooper 1892 The U.S. Supreme Court: the highest court in the land. Their job: to decide the constitutionality of cases. But is that what they are really doing? Can we trust that their decisions are just? Two important cases in history can help answer this question. A 1896 U.S. Supreme Court case, Plessy v. Ferguson, made facilities and schools separate based on race. In another case in 1954, Brown v. Board of Education, the court reversed its decision and said that separate was not equal. These two cases teach two lessons about the U.S. Supreme Court. Plessy shows that our justice system has failed at times to establish justice. Brown shows that even though the Court rules justly, justice isn’t guaranteed. Many events led up to Plessy v. Ferguson. For example: after the Congress withdrew federal troops from the South in 1877, conditions for blacks deteriorated. The government pushed blacks into an inferior position. The government took action to prevent blacks from voting immediately. They embarked poll taxes, “grandfather clauses”. They also segregated on trains, in parks, schools, restaurants, theaters, swimming pools, and even cemeteries. If blacks broke these segregation laws, they were likely to end up either in prison or dead! The case of Plessy v. Ferguson was a very important case in American History because it enforced segregation even making it legal, and made segregation a concrete reality for the people of the United States. It began with a man called Homer Plessy. Plessy was 7/8 white and only had 1/8 drop of black blood in him, but under Louisiana law, was considered black. In 1890, Louisiana passed a law providing that “all railway companies carrying passengers in their coaches in this state shall provide equal but separate accommodations for the white and colored races, by providing two or more passenger coaches for each passenger train, or by dividing the passenger coaches by a partition so as to secure separate accommodations.” Plessy believed that the law was unjust and so he challenged the law by refusing to leave the white railroad car. He was arrested and taken to trial. At this trial he argued that the Separate Car Act violated the Thirteenth and Fourteenth Amendments to the Constitution. But he was found guilty. Plessy then appealed the decision to the Supreme Court of Louisiana. Again his case was upheld. Plessy appealed again in 1896 to the Supreme Court of the United States. Homer Plessy was found guilty once again. The impact of the court’s decision was a harsh one. It created a reality that was a nightmare to many. Their lives would be changed dramatically. They would officially be separated and considered low down in society. Plessy v. Ferguson was the law of the land until 1954, when it was finally, successfully overturned by Brown v. Board of Education. In 1954, a little girl named Linda Brown in Topeka, Kansas had to walk 5 miles to school. She didn’t get recess and could not play with any of the other children who were all white. Her parents filed a case to the U.S. Supreme Court saying that there is no way blacks and whites could get equal education if they were separated. The court ruled that separate is not equal. The amount of time between Plessy v. Ferguson and Brown v. Board of Education shows just how long it took to get justice for blacks from the Supreme Court. It amazes me that our government could even question if blacks have the right to justice. It should be basic knowledge for us to know that it is wrong to treat any people so unjustly. Just to prove my point here are some questions you can ask yourself: are blacks human beings just like whites? Do blacks and whites both have feelings and needs? And finally, is the only difference between blacks and whites is that they have a different complexion? I am confused as to why so many people, including Justices on our Supreme Court would not answer yes to all these questions. How could anyone who had any intelligence think it was acceptable to treat blacks differently? Fortunately the Court did come to its senses in Brown v. Board of Education. Yet just because The U.S. Supreme Court ruled that separate is not equal it did not mean that blacks were automatically treated equally. After Brown v. Board of Education happened, there needed to be the Civil Rights Movement, in which many people were involved to push society to change. Two people who led the Civil Rights Movement were Martin Luther King Jr. and Rosa Parks. We must acknowledge that it wasn’t only those people, there were others working and helping the same cause. There were many ways that they impacted The Civil Rights Movement. They gave speeches, wrote letters, led marches, held meetings and many other strategies. They also endured mental and physical hardships. Only through the Civil Rights Movement did the promise of Brown actually get achieved. These people were poor, wealthy, high class, low class, black, some white, short and tall. Basically, there was a wide range of different kinds of people. Not everyone automatically changed their frame of mind when The U.S. Supreme Court ruled separate is not equal. There were still many people out there who were racist and wanted to keep blacks in an inferior position. What You Need to Know Before Placing an Ad in Your Local Newspaper (or ANY Other Publication)

Sunday, October 7th, 2007

By Connie Scholl Have you been considering placing an advertisement in your local newspaper in hopes of drumming up some new business? Wait! Before you whip out your wallet, take a moment to familiarize yourself with the following four “rules of the road” to help you improve your chances of getting the response you’re seeking. Rule #1: You’ve Got to Choose the RIGHT Publication. For example, if you’re targeting affluent clients and offering a high-end service (such as in-home personal training, massage, dog walking, etc), don’t make the mistake of wasting your advertising dollars by placing an ad in the bargain news. Do your homework and find out what your target market is actually READING (you never know, maybe they ARE reading the bargain news!), and then apply your marketing dollars where there is the greatest opportunity. The success of any advertising or direct mail campaign can very often be attributed to the following: 50% of your “success” at advertising will depend on targeting the right publication; 25% of your “success” at advertising will depend on the copy in the ad; and 25% of your “success” at advertising will depend on the actual offer. Rule #2: Get Yourself a Traffic-Stopping HEADLINE! Your headline must quickly tap into the reader’s problem, need or desire, and instantly prompt them to read further. Take your time with the headline. It needs to quickly create interest and intrigue in your reader. In fact, when I’m writing ads for clients, I’ll spend 75% of my time on the headline alone! (If they don’t read the headline, the rest of the ad is useless!) Rule #3: Don’t Ever Forget, the Ad is NOT about YOU. How many times have you seen the “all about me” ads from other professionals in your industry? You know the ones I’m referring to — the business owner’s name takes up 50% of the ad, while the other half is filled with a laundry list of credentials and other self-centered copy. (This is the biggest mistake I see professionals make.) I’m not saying this information shouldn’t be included, it just shouldn’t take up the “prime marketing real estate” section in your advertisement. Remember, your objective is to tap into your prospects’ problem or need, and get an immediate response — right then and there — before recycling day comes around and your expensive ad takes a one-way trip to the dump. How do you do this? By offering them what they want. (For example, a f.ree trial session or consultation, a report or article containing tips on how to solve their particular challenge, a no-appointment-necessary policy, etc.) Essentially, use this advertisement as a way to generate hot leads for your services. Plan on running your ad at least 7-10 times before getting a regular stream of calls from it. Rule #4: Understand the Power of Your Words. Pay close attention to the WORDS you select for your ad. (Here’s where knowing your target market inside and out really comes in handy!) While ad writing is a skill that takes time to master, you can jump-start the learning process by closely studying other ads that move YOU to take action, or you can simply hire someone to write a compelling ad for you. Here’s a simple formula I use to keep me on track when I’m writing for my clients: YOUR AD SHOULD DO THE FOLLOWING: Get their ATTENTION Quickly Maintain INTEREST Create a Burning DESIRE for What You’re OFFERING Finally, the ad should move your reader to TAKE A SPECIFIC ACTION!
